In many jurisdictions, the system also incorporates restorative justice practices, including mediated encounters between offenders and victims.

Sentencing typically offers a range of sanctions, from fines and community service to probation, suspended sentences, and imprisonment. Some systems also use alternatives to incarceration, such as electronic monitoring, treatment programs, or mediation. The emphasis on punishment versus rehabilitation varies by country and over time, influencing rates of incarceration and recidivism.

Core principles include legality, due process, proportionality of penalties, humane treatment, and nondiscrimination. Oversight, data collection, and periodic reform debates shape policy, with ongoing discussions about efficiency, human rights, mental health support, and social reintegration.
