Staatsgeheim (German for “state secret”) refers to information classified by a government as essential to national security, the protection of public order, or the safeguarding of diplomatic relations. The concept is rooted in German law, where the term appears in the Strafgesetzbuch (Criminal Code) and special legislation such as the Gesetz über die Durchführung von Maßnahmen nach dem Gesetz zum Schutz von Staatsgeheimnissen (Law on the Execution of Measures under the State Secrets Act). Under these provisions, the unauthorized disclosure, acquisition, or possession of a Staatsgeheim can be punishable by imprisonment, fines, or both, depending on the gravity of the breach.

Historically, the legal framework for Staatsgeheim originated in the early 20th century, evolving through the Weimar Republic, the Nazi era, and the post‑World War II division of Germany. In the Federal Republic of Germany, the 1951 State Secrets Act and its 2009 amendment delineate the categories of classified material, the authorities authorized to designate secrets, and the procedures for handling, storing, and declassifying information.
