Rendilepingute

Rendilepingute (rental agreements) are legal contracts in which a landlord provides the use of real estate or other property to a tenant in exchange for rent. They cover housing, commercial premises, and the rental of movable property such as equipment.

In Estonia, rendilepingud are governed primarily by the Law of Obligations Act (Võlaõigus). While a contract does not always have to be in writing, a written agreement is strongly recommended because it clearly records terms and obligations and reduces disputes.

Leases can be for dwellings, commercial spaces, or movable goods. A contract typically specifies the parties, a description of the property, the rent amount and payment dates, the duration or term of the lease, and the security deposit. It may also address maintenance responsibilities, contact points for repairs, utilities, and house rules, as well as any rules about subletting or use of the property.

Rights and obligations depend on the contract and the law. The tenant is expected to pay rent on time, use the property responsibly, and report major repairs. The landlord must ensure the tenant’s right to quiet enjoyment and carry out essential repairs as agreed or required by law. A security deposit may be used to cover unpaid rent or damages, as specified in the contract.

Termination and renewal: leases can be fixed-term or open-ended. Termination generally requires notice and may be subject to specific conditions for early termination or non-renewal. Subletting or assignment usually requires the landlord’s consent.

Disputes arising from rendilepingud are typically resolved through negotiation, mediation, or civil courts, with district courts handling most rental disputes under Estonian law.
