Przedawnienia

Przedawnienia is a legal concept in Polish law that refers to the time limits within which civil, criminal, administrative, and tax actions or claims must be brought to court or otherwise asserted. Once the statutory period elapses, the claimant loses the right to enforce the claim, although the underlying right may still exist. The doctrine is intended to promote legal certainty and prevent the indefinite threat of litigation.

The term is defined in Article 102 of the Polish Civil Code, which establishes general rules for the commencement and calculation of limitation periods. The periods vary depending on the nature of the claim: for contractual obligations, the default limitation period is three years, while for property claims it can be up to thirty years. Criminal proceedings normally have a ten‑year limitation period, with longer periods for serious offences such as treason or murder. Tax claims, administrative acts, and certain consumer disputes are governed by specific statutory provisions that set their own deadlines.

Przedawnienie may be interrupted or suspended. A breach of duty, a judicial or administrative act, or the filing of a complaint can stop the clock, after which the period may resume from the point of cessation. Certain actions, such as the registration of a judicial decision or the acquisition of property, can also renew or extend the limitation period.

The concept is routinely invoked in civil court judgments. For example, a landlord may assert that a tenant's claim for damages is przedawnione, preventing the tenant from receiving compensation after the period has expired. However, courts may still evaluate whether the preceding limitation period has truly passed if a party alleges premature limitation.
