Particulierrechtelijke

Particulierrechtelijke is a Dutch adjective used to indicate a connection with private law, or the part of the law that governs relations between private individuals and private entities. In Dutch and Belgian legal contexts, private law is contrasted with public law, which concerns the relationship between individuals and state authorities, and with criminal law.

Private law encompasses core areas such as obligations (contracts and delicts or torts), property law, family law, inheritance, and corporate or civil-commercial law. The rules and doctrines of private law are typically codified in civil codes or private-law statutes, and they regulate how private parties interact, create and enforce obligations, and resolve private disputes.

The term is commonly used in scholarly writing, judicial decisions, and legislative language to describe issues, remedies, or liability that arise under private law rather than under public or administrative law. For example, private-law liability (particulierrechtelijke aansprakelijkheid) addresses when and how a private party may be held responsible for harm or breach of duty, as opposed to liability arising from public-law contexts.

In contemporary Dutch legal usage, synonymous or closely related formulations include privaatrechtelijk or partikulierrechtelijk, depending on stylistic and regional conventions. The broader concept aligns with the idea of civil law (Burgerlijk recht in the Netherlands; Droit civil in many Francophone contexts) and with the umbrella term privaterecht or privaatrecht in different jurisdictions.
