The purpose of this provision is to provide a safety net against exploitative or one-sided agreements, ensuring that contracts do not lead to unjust outcomes.

The application of oskälighetsdirektiv is not automatic. It requires a court to assess the circumstances surrounding the contract's formation, its content, and any subsequent developments. Factors considered include the bargaining power of the parties, whether one party was in a vulnerable position, the clarity and understanding of the terms, and the overall fairness of the agreement in light of societal norms. Oskälighetsdirektiv can lead to several outcomes.
