Marknadsföringsrättsliga refers to the legal framework governing marketing activities. In Sweden, this area of law primarily aims to protect consumers and ensure fair competition among businesses. The core legislation is the Marketing Practices Act (Marknadsföringslagen), which prohibits aggressive and misleading marketing. Aggressive marketing involves practices that impair a consumer's ability to make an informed decision through harassment, coercion, or undue influence. Misleading marketing, on the other hand, involves untrue or misleading information that can influence a consumer's economic decision, or omission of crucial information that leads to the same outcome.

The Swedish Consumer Agency (Konsumentverket) is the main supervisory authority responsible for enforcing these regulations. They can issue injunctions and prohibitions to companies that violate marketing laws. In addition to the Marketing Practices Act, other laws also touch upon marketing, such as the terms of Sale of Goods Act (Köplagen) and the Consumer Services Act (Konsumenttjänstlagen), which set standards for product information and service provision. Furthermore, specific sectors might have additional regulations, for instance, regarding advertising for financial services or alcohol. The overarching goal is to create a transparent marketplace where consumers can trust the information they receive and businesses can compete on fair terms.
