Konkurshantering

Konkurshantering, often translated as bankruptcy management or insolvency proceedings, refers to the legal and administrative processes involved when an individual or a company is unable to meet their financial obligations. This can lead to a formal declaration of bankruptcy, initiating a structured approach to deal with the debts and assets. The primary goal of konkurshantering is to ensure a fair and orderly distribution of the debtor's assets among creditors, while also providing a framework for potential rehabilitation or liquidation.

In Sweden, the process is governed by the bankruptcy law (konkurslagen). When a debtor is declared bankrupt, a bankruptcy trustee (konkursförvaltare) is appointed by the court. This trustee is responsible for taking control of the debtor's assets, assessing their value, and managing the sale of these assets. Simultaneously, creditors are invited to file their claims with the trustee. The trustee then reviews these claims and establishes a priority order for repayment based on legal statutes.

Konkurshantering can take different forms depending on the nature of the debtor and the circumstances. For companies, it typically leads to liquidation, where the business ceases to operate and its assets are sold off. For individuals, it can sometimes involve a restructuring of debts to allow for repayment over time, though outright liquidation of assets is also common.
