Kansspelwet

Kansspelwet is the Dutch Gambling Act that forms the core regulatory framework for games of chance in the Netherlands. Its primary aims are to organize gambling activities, protect players, prevent criminal activity and addiction, and ensure the integrity and fairness of gambling operations.

The scope of the Kansspelwet covers operators that offer games of chance to Dutch residents or on Dutch territory, including land-based casinos, betting shops, lotteries, and, under licensed arrangements, online gambling. The law defines what constitutes a kansspel (game of chance) and sets out what activities require licensing and supervisory oversight.

Licensing and regulation are central elements of the act. The regulator Kansspelautoriteit (KSA) issues licenses, monitors compliance, and enforces rules related to consumer protection, responsible gambling, advertising standards, and financial integrity. Operators must meet stringent criteria, including probity, financial reliability, and safeguards for players.

Online gambling has been significantly affected by amendments to the Kansspelwet. A licensing regime for remote gambling was introduced and expanded in the 2020s, allowing legally operating online bookmakers and casinos under KSA supervision. Licensees are required to implement strong age verification, player-protection measures, self-exclusion options, and anti-money laundering controls.

Consumer protection and safeguards are embedded in the law. Minimum age is set at 18, and the act promotes responsible gambling, clear terms of service, transparency of winnings, and safeguards against fraud. Advertising is regulated to minimize excessive or misleading promotion.

Enforcement and penalties for non-compliance include fines, license suspensions or revocation, and potential criminal sanctions. The Kansspelwet has evolved through reforms over the decades, with the creation of the Kansspelautoriteit in 2012 and ongoing updates to address changes in the gambling landscape, including online services.
