Injunctioner

Injunctioner is a term rarely used in modern jurisprudence. It is not an official professional designation, and in everyday practice the authority that issues injunctive relief is a court or judge, not a person titled “injunctioner.” The word appears mainly in historical texts, translations, or fiction, where it may be used to refer to the actor who grants or enforces an injunction.

An injunction itself is a court order that requires a party to do or refrain from specific conduct. Its purpose is to preserve the status quo or prevent irreparable harm while a case proceeds, or to protect legal rights from ongoing or imminent infringement. Types of injunctive relief include temporary restraining orders, preliminary injunctions, and permanent injunctions, each with different procedural stages and standards.

To obtain an injunction, a party typically files a motion or application with a court. Courts commonly assess factors such as the likelihood of success on the merits, the potential for irreparable harm absent relief, the balance of harms between the parties, and, in some jurisdictions, the public interest. Some orders require a bond or security to cover potential damages if the injunction is later found to have been unjustified.

Enforcement and limits: Violating an injunction can trigger contempt of court and penalties. Injunctions can be modified or dissolved if circumstances change or if the underlying case resolves.

In contemporary practice, the appropriate terminology is the judge or court issuing the injunction, not an injunctioner. The term remains of historical or fictional interest rather than a formal designation in most legal systems.
