Güterstandssachen

Güterstandssachen, a German legal term, refers to legal disputes concerning the property regime between spouses. This regime governs how assets and debts are managed and divided during the marriage and in the event of divorce or death. There are several types of Güterstände recognized in German law, including the Zugewinngemeinschaft (community of accrued gains), Gütertrennung (separation of property), and Fahrnisgütergemeinschaft (community of movables).

The Zugewinngemeinschaft is the default statutory marital property regime in Germany. Under this system, each spouse retains ownership of their pre-marital assets and any assets acquired during the marriage. However, upon dissolution of the marriage, the gains each spouse has made during the marriage are calculated, and the spouse with the lesser gain is entitled to half of the difference from the spouse with the greater gain.

Gütertrennung, or separation of property, means that each spouse’s assets and debts remain entirely separate throughout the marriage and upon its dissolution. Neither spouse has a claim to the other's gains. Fahrnisgütergemeinschaft is a less common regime where spouses agree to share ownership of movable property acquired during the marriage.

Disputes, or "Sachen," arise when spouses cannot agree on the application or division of assets under their chosen or statutory Güterstand. These cases often involve complex valuations of assets, tracing of funds, and legal arguments regarding what constitutes marital property and what is considered separate. Legal proceedings for Güterstandssachen typically take place within family courts.
