Gewerberecht

Gewerberecht refers to the body of law that governs the creation, operation and supervision of commercial and craft enterprises in German-speaking countries. It defines what constitutes a trade, which activities require official authorization, how businesses must be registered, and how authorities ensure compliance. The scope includes registration procedures, licensing regimes, prohibition of unfair practices, and consumer- and safety-related requirements. While often described as a subset of commercial law, it intersects with professional regulation, taxation and competition rules.

In Germany, Gewerberecht is largely shaped by the Gewerbeordnung (GewO) and the Handwerksordnung (HwO). The GewO sets general rules for commercial activity, including the obligation to register a business with the local Gewerbeamt, the display of business data, and rules on advertising and operating conditions. It establishes the principle of Gewerbefreiheit, subject to licenses, permits or prohibitions. The HwO regulates crafts and trades that require licensing or master-trade supervision; many crafts require a Meisterbrief or operate under specific exemptions. Local authorities issue registrations and licenses and supervise compliance, with enforcement mechanisms for violations.

In Austria and Switzerland, Gewerberecht likewise combines free trades and regulated trades. Registration with competent authorities, and in some cases professional qualifications, enable lawful operation. The exact rules vary by jurisdiction, but the overarching aim is to enable entrepreneurial activity while protecting consumers, ensuring safety and fair competition.

Gewerberecht thus forms a foundational component of the wider public and economic order, closely linked to administrative procedure, professional regulation and tax law.
