Gewalten

Gewalten is a German constitutional term referring to the three branches of state power: legislative, executive, and judicial. The concept is central to the principle of Gewaltenteilung, or separation of powers, which is a fundamental element of modern democratic systems.

In the context of the German Basic Law (Grundgesetz), the three Gewalten are clearly distinguished. The legislative power is vested in the parliament (Bundestag and Bundesrat), which is responsible for lawmaking. The executive power is exercised by the government, headed by the Federal Chancellor, along with the federal administration. The judicial power is held by independent courts, with the Federal Constitutional Court serving as the highest authority.

The principle of separating these powers originated from the political philosophy of Montesquieu and is designed to prevent the concentration of authority in any single institution. Each branch has distinct functions and can exercise checks and balances over the others, ensuring that no single entity can dominate the state apparatus.

This division serves to protect individual freedoms and maintain the rule of law by creating a system of mutual oversight and limitation. The German constitution explicitly mandates that state authority must be bound by the constitutional order, with the three Gewalten operating within their designated spheres while maintaining their independence from one another.
