GDPRtilsyn

GDPRtilsyn is the term used in some jurisdictions to describe the supervisory activities under the General Data Protection Regulation (GDPR) carried out by the national data protection authority. Each EU and EEA member state appoints a data protection authority (DPA) responsible for monitoring GDPR compliance within its territory, handling complaints, and promoting privacy rights. GDPRtilsyn encompasses oversight of both data controllers and processors, guidance on lawful processing, and enforcement when violations occur.

DPAs have powers to conduct investigations and audits, request information, and issue corrective orders. They can require changes to processing activities, suspend or restrict processing, and impose administrative fines up to GDPR’s limits (up to 20 million euros or 4% of annual global turnover, whichever is higher). They also handle data breach notifications and determine outcomes related to data subject rights.

Individuals can lodge complaints with the relevant DPA, which investigates alleged violations and determines appropriate remedies. DPAs publish guidance, codes of conduct, and impact assessment support to assist organizations in achieving compliance. For cross-border processing, the One-Stop-Shop mechanism coordinates enforcement among DPAs, with the lead authority handling the case and the European Data Protection Board guiding consistency.

GDPRtilsyn activities have shaped privacy enforcement since 2018, encouraging organizations to implement data protection by design and to maintain documentation of processing activities. The approach aims to strengthen data subjects’ rights and provide clear avenues for enforcement, while discussions continue about resources and case processing times in various jurisdictions.
