Fullmektigens

Fullmektigens is a Norwegian legal phrase used to describe the rights and duties associated with acting as a fullmektig, or proxy, for another person (the principal). In Norwegian civil and administrative law, a fullmektig is empowered to perform acts on the principal’s behalf within the scope defined by a fullmakt (power of attorney).

Creation and scope: Authority is granted in a written document or by lawful designation. A fullmakt can be general, allowing broad authority, or limited to specific tasks or time frames. The agent’s powers apply only to acts within the defined scope and can typically be revoked or amended by the principal. The relationship ends when the authority is exhausted, revoked, or the principal dies; some acts may require formal steps, such as notarization, depending on the context.

Duties and liabilities: The fullmektig must act in the principal’s best interests, avoid conflicts of interest, and keep accurate records. If acting beyond the scope, the fullmektig may incur liability to the principal or to third parties; the principal may be bound by acts performed within the defined authority. The fullmektig’s duties are fiduciary in nature, and misuse or negligence can lead to civil claims.

Context and usage: In personal affairs, a parent or guardian may act as fullmektig for a minor; in business, a manager or attorney may be designated to sign contracts; in estates, an executor or administrator may serve as fullmektig for the deceased’s affairs. The term underscores the legal mechanism by which individuals and organizations appoint others to act on their behalf.
