Forbrugerretten

Forbrugerretten is the Danish term for consumer law, the body of rules that regulate the relationship between consumers and traders in Denmark. It covers the purchase of goods and services, including offline, online, and digital content, and aims to ensure fair treatment, clear information, and safety in the market. The framework is built from national legislation and is shaped by European Union directives on consumer protection.

The main Danish instruments include the Forbrugeraftaleloven (law on consumer contracts) and related provisions within Konkurrence- og Forbrugerlovgivningen. The Danish Consumer Ombudsman (Forbrugerombudsmanden) supervises marketing practices and enforces consumer-protection rules, while other bodies such as the Consumer Complaints Board handle disputes. The Danish Business Authority (Erhvervsstyrelsen) also contributes to the administration of the rules.

Key rights under forbrugerretten include the obligation for traders to provide clear information about prices, terms, delivery, and guarantees. Consumers have a 14-day cooling-off period for distance contracts and off-premises sales, allowing withdrawal without giving a reason. Goods bought by consumers carry a two-year liability period for defects, with remedies that may include repair, replacement, price reduction, or termination of the contract. Digital content and services must perform as promised, with appropriate remedies for defects or non-delivery. Unfair contract terms and misleading marketing are prohibited.

Enforcement and dispute resolution involve contacting the trader for resolution, or appealing to the Forbrugerombudsmanden for guidance and enforcement. If needed, disputes can be taken to courts or to consumer dispute bodies. The EU framework also supports cross-border consumer rights and redress within member states.
