Eigentümerversammlungen

Eigentümerversammlungen, often translated as owner meetings or homeowners' association meetings, are formal gatherings of the owners of individual units within a condominium or a similarly structured property development. These meetings are a fundamental mechanism for collective decision-making and management of the common property. Typically, they are held at least once a year, with additional meetings convened if urgent matters arise.

The primary purpose of an Eigentümerversammlung is to discuss and vote on issues pertaining to the administration and maintenance of the shared areas and facilities. This includes approving the annual budget, determining the amount of monthly service charges (Hausgeld), and deciding on necessary repairs or improvements to the building. Owners also elect or re-elect members of the owner's committee (Beirat), which assists the property manager in overseeing the administration.

Key decisions made at these meetings are legally binding for all owners, regardless of whether they attended. The agenda is usually set in advance and distributed to all owners, along with invitations. During the meeting, owners have the right to vote on agenda items, and their votes are typically weighted according to their ownership share. Minutes of the meeting are recorded and distributed afterwards, documenting all decisions made and votes cast. Proper notice and the established voting procedures are crucial for the validity of the resolutions passed.
