Counterdebts

Counterdebts are a legal concept primarily found in civil law jurisdictions. They refer to obligations that arise between parties in a contract or lawsuit where one party owes the other a debt, but the other party also has a claim or debt against the first. Essentially, it's a situation where there are reciprocal debts existing simultaneously between the same individuals or entities.

The concept of counterdebts is often linked to the broader legal principle of set-off or compensation. Set-off allows parties with mutual debts to extinguish each other to the extent of the lesser amount. This prevents the inefficient process of parties paying each other the full amounts of their respective debts, only for one to have to seek reimbursement for the difference.
