Contratante

Contratante is a term used in civil and commercial law, particularly in Spanish- and Portuguese-speaking contexts, to refer to the party that hires another party to provide goods or services. In English, the closest equivalent is the contracting party. The contratante can be an individual, a company, or a public authority, and it represents the client or buyer in a contractual relationship.

The core function of the contratante is to define the scope and terms of the engagement, including the work to be performed, deliverables, deadlines, price, and payment schedule. It may also specify quality standards, performance criteria, and penalties for breach. The contratante is typically responsible for providing necessary information, access, and resources, as well as for supervising performance and accepting or rejecting deliverables according to the contract. Payment and compliance with applicable laws and regulatory requirements are common obligations of the contratante.

In relation to the other party, commonly called the contratado or provider, the contratante bears the risk associated with ordering and financing the work, subject to any risk allocations stated in the contract. The precise rights and duties of the contratante depend on the applicable law and the contract's terms, which may address issues such as termination, warranties, liability, and remedies for non-performance.

The term is also used in procurement and public contracting to denote the entity that initiates and funds a contract for goods or services. Context determines whether contratante refers to a private client, a corporate client, or a government body.
