Betretung

Betretung is a German legal term that translates to "entry" or "access" in English. It refers to the right of a person or entity to enter another's property. This right is not absolute and is typically governed by specific legal provisions and circumstances.

In property law, Betretung often relates to easements or servitudes, where a property owner grants a neighbor or other party the right to cross their land for a specific purpose, such as accessing a road or utility lines. This right is usually established through a contract or a legal decree.

Beyond contractual agreements, Betretung can also be legally mandated in certain situations. For instance, authorities may have the right to enter private property for law enforcement purposes, inspections, or emergency response. Landlords may also have the right to enter a tenant's rented property under specific conditions, such as for repairs or to inspect the premises, provided they give reasonable notice.

However, the right of Betretung is balanced by the principle of inviolability of the home (Unverletzlichkeit der Wohnung). Unauthorized entry onto private property is considered trespassing and can have legal consequences. Therefore, any exercise of Betretung must be justified by law or by the consent of the property owner. The scope and limitations of Betretung are crucial considerations in German property and civil law.
