Üüritehing

Üüritehing is an Estonian legal term that refers to a rental agreement or lease contract between a property owner (lessor) and a tenant (lessee). It establishes the rights and obligations of both parties regarding the use and possession of a specified property, typically real estate such as apartment, house, or commercial premises.

The agreement usually contains essential details such as the duration of the lease, the amount of rent, payment terms, and conditions for renewal or termination. It may also specify the responsibilities concerning maintenance, repairs, and usage restrictions, aiming to protect the interests of both parties.

In Estonia, üüritehing is governed by the Law of Obligations Act (Võlaõigus). The law stipulates that a tenancy agreement can be either oral or written, although written agreements are recommended for clarity and legal enforceability. A typical üüritehing must include the identities of parties, property description, rent amount and payment schedule, duration, and any specific conditions agreed upon.

Legal protections for tenants include regulations on rent increases, notice periods for termination, and conditions for deposit returns. Landlords are obliged to ensure the property meets safety and health standards and to respect the tenant’s right to quiet enjoyment of the premises.

Disputes arising from üüritehing are generally resolved through negotiation, mediation, or judicial proceedings in courts. Properly drafted agreements aim to minimize conflicts, ensure clear terms, and uphold the rights of both landlords and tenants within the Estonian legal framework.
