Átruházásra

Átruházásra is the Hungarian term used to describe the act of transferring rights, ownership or possession from one party to another. In civil and commercial law it denotes the process by which a person or entity makes a legal transfer of entitlement, obligation or title to a different holder. The form “átruházására” appears in legal texts to indicate the purpose or recipient of the transfer.

The concept covers a broad range of transfers, including movable and immovable property, as well as claims, licenses or other rights. Common concrete forms of átruházás are adásvétel (sale), ajándékozás (donation), öröklés (inheritance) and the assignment of claims (követelések átruházása). In many contexts átruházás is tied to specific procedural steps and accompanying contracts that define the scope of the transferred rights and the obligations of each party.

Formalities and procedures vary by asset type. Transfers of movable property can often be effected by a contract between the parties, whereas transfers involving real estate require a formal deed and registration in the relevant land or property registry, typically with additional notarial or official procedures. Transfers of claims or rights may require a written assignment agreement and, in some cases, consent from other involved parties, such as creditors or lenders.

Effects and limitations also depend on the type of transfer. Once an átruházás is validly completed, the transferee generally acquires the legal title, ownership or right, including associated risks and benefits, subject to the terms of the transfer and applicable law. Certain rights or personal obligations may be non-transferable or require consent under statute or contract.
