Velkajärjelysten, often translated as debt restructuring or debt arrangement, refers to a legal process in Finland designed to help individuals who are over-indebted to manage their financial difficulties and create a sustainable repayment plan. This process is primarily intended for private individuals and aims to provide a structured way to deal with overwhelming debt.

The core of velkajärjelysten is the establishment of a repayment arrangement overseen by a local legal aid office (oikeusaputoimisto) or a designated trustee. The debtor proposes a plan outlining how they will repay their debts over a specified period, typically three to five years. This plan usually involves a significant reduction in the total amount owed, as creditors are often willing to accept a partial repayment to recover some of their funds rather than risk receiving nothing if the debtor becomes completely insolvent.

To initiate velkajärjelysten, an individual must apply to the enforcement office (ulosottoviranomainen) or a legal aid office. A preliminary assessment is made to determine if the applicant genuinely meets the criteria for being over-indebted and if a repayment arrangement is a viable solution. If the application is accepted, a trustee is appointed to assist the debtor in negotiating with creditors and formalizing the repayment plan.

The court then approves the final debt arrangement. Once approved, the debtor is legally bound to adhere to the terms of the plan, making regular payments to the trustee. Creditors are also bound by the arrangement, meaning they cannot pursue individual collection efforts outside of the agreed-upon plan. Successful completion of the velkajärjelysten can lead to the discharge of the remaining debt, offering the individual a fresh financial start. This process is a last resort for those facing severe financial distress, providing a structured pathway towards solvency.
