tényállást

Tényállás (tényállás, tényállást in object form) is a term used in Hungarian law to denote the actual factual circumstances surrounding a case. It refers to the set of events, actions, conditions, and other relevant details that have occurred and are material to the dispute or charge.

In legal practice, the tényállás is established through evidence and argument in proceedings. The court or arbitration body collects and assesses testimonies, documents, expert opinions, and other proof to articulate the factual state of affairs. This factual description is intended to be objective and specific, separating the description of what happened from the legal interpretation of those facts.

A typical tényállás includes who did what, when and where the events occurred, the sequence of actions, any consequences, and the contexts in which those events took place. It should focus on verifiable details and refrain from legal conclusions. Once the facts are determined, the court applies the relevant law to these facts, which leads to the legal qualification of the case (for example, whether a crime was committed or whether liability exists).

The tényállás is distinct from what parties may allege as facts (tényállítás). While parties may present different versions of the facts, the court must determine the established tényállás based on the evidence and issue a judgment that states both the facts found and the legal reasoning.
