Takaajat are guarantors in Finnish contract language. A takaaja is a person or organization that agrees to fulfill the obligations of another party (the debtor) if the debtor defaults. Guarantors are commonly required in loans, leases, or other credit arrangements to reduce risk for lenders and to provide additional assurance that the obligation will be paid.

Liability and scope follow the terms of the guarantee agreement. In an individual guarantee, one guarantor bears the liability; in a joint guarantee, each guarantor may be liable for the full debt, and the creditor may demand payment from any one guarantor before seeking contributions from others. The exact scope, including the amount and duration of the guarantee, is defined in the guarantee document. If the guarantor pays part or all of the debt, they usually obtain a right of recourse against the debtor (subrogation) or an indemnity from the debtor.

Rights and release: Guarantors typically have the right to information about the debtor’s performance and, in many cases, to require the creditor to attempt recovery from the debtor before calling on other guarantors. A guarantee can be released by mutual agreement, by expiration of its term, or when the debtor’s obligations are fully discharged. Certain changes to the contract or the debtor’s circumstances may also affect the validity or scope of the guarantee.

Practical notes: Guarantees carry significant risk and should be entered with clear terms. They are common in consumer lending and tenancy, but may be subject to regulatory rules and consumer protections that govern unfair terms. Guarantors should carefully assess the debtor’s ability to repay and seek professional advice if needed.
