Staatsrechtspraak, or constitutional jurisprudence, is the branch of public law that studies and applies the constitutional framework of a state. It concerns the distribution and limits of governmental power among the legislative, executive, and judiciary, and the protection of fundamental rights. The field covers questions about the organization of the state, the powers of public institutions, the procedure for constitutional amendments, and the relationship between different levels of government (for example, central and regional authorities). It also addresses the interpretation and application of constitutional norms in concrete cases, and the remedies available when rights are violated.

In practice, staatsrechtspraak is exercised by courts and, in some systems, specialized constitutional or supreme courts. In many countries there is a dedicated constitutional court with powers of constitutional review. In the Netherlands, however, there is no separate constitutional court with general power of striking down legislation. Constitutional questions are resolved through the regular judiciary, notably the Supreme Court (Hoge Raad) and the Council of State (Raad van State), which also issues advisory opinions on proposed legislation and serves as the highest administrative court. Dutch constitutional law is anchored in the Grondwet (Constitution) and grondrechten (fundamental rights). Other jurisdictions may organize staatsrechtspraak differently, but the core aim remains the same: to ensure that governmental action complies with the constitutional order and that the rights of individuals are protected.
