The term is not widely standardized and is more commonly described as the defense case or the defense presentation in many jurisdictions.

In common law systems, the defensepresent typically occurs after the prosecution has presented its evidence and after any pretrial or in-trial motions related to admissibility have been resolved. During this phase, the defense may call witnesses, present documentary or physical exhibits, and offer expert testimony. The defense must also handle direct examination of its witnesses and respond to the prosecution’s cross-examinations.

Procedural considerations include the burden of proof and standard of evidence. In criminal cases, the burden of proof remains with the prosecution to prove guilt beyond a reasonable doubt; the defense is not required to present evidence but may do so to create reasonable doubt, challenge credibility, or offer alternative explanations.
