Zuschlagsweg is a term used in German procurement to denote the procedural path leading to the awarding of a contract. It describes the sequence from the call for bids through evaluation to the final award decision and contract formation. The concept rests on the principles of public procurement law, including transparency, equal treatment, and non-discrimination.

Legal framework: In Germany, the process is governed by the Gesetz gegen Wettbewerbsbeschränkungen (GWB) and the Vergabeverordnung (VgV), as well as EU directives implemented in national law. Public authorities must publish clear tender documents, define award criteria in advance, and apply them consistently to all bidders. The award decision (Zuschlag) is usually made to the bidder whose tender is deemed most advantageous or economically favorable according to the predefined criteria.

Process: After publication, bidders submit proposals, which are evaluated by a committee or designated evaluators against the established criteria (such as price, quality, delivery time, and, where applicable, social or environmental factors).
