Vinovnost

Vinovnost is a Czech noun meaning guilt, culpability, or responsibility for a fault or wrongdoing. It is used in everyday language as well as in professional discourse across ethics, law, psychology, and philosophy. The term encompasses two closely related but distinct notions: moral guilt, which concerns blameworthiness in a person for an action or omission, and legal guilt, which concerns liability under a legal system.

In moral terms, vinovnost depends on elements such as intention, awareness of consequences, and control over one’s actions; factors like coercion, ignorance of law, or diminished capacity can offset or remove moral blame. In legal contexts, vinovnost is tied to the existence of a prohibited conduct (actus reus) and a requisite mental state (mens rea) or other liability bases; some jurisdictions also recognize strict liability without fault. The assessment relies on evidence, standards of proof, and applicable statutes, with defenses and remedies shaping outcomes.
