Vastutusnõudeid, or claims for liability, refer to legal demands made by one party against another, asserting that the latter is responsible for causing harm or loss. This responsibility typically arises from a breach of a legal duty, such as negligence, breach of contract, or a strict liability offense. The party making the claim, known as the claimant or plaintiff, seeks compensation or other remedies from the party alleged to be liable, referred to as the defendant.

The basis for a vastutusnõue can stem from various situations. In tort law, negligence is a common ground, where a defendant's failure to exercise reasonable care results in injury to the plaintiff. Examples include car accidents caused by careless driving or medical malpractice. Contract law provides recourse when one party fails to fulfill their contractual obligations, leading to financial losses for the other party. Strict liability applies in certain situations where liability is imposed regardless of fault, such as in product liability cases where a defective product causes harm.

To establish a successful vastutusnõue, the claimant generally needs to prove several elements: the existence of a duty of care, a breach of that duty, causation (that the breach directly led to the harm), and damages (actual loss suffered).
