Uthyrningsakter

Uthyrningsakter are rental documents that formalize an agreement between a landlord (uthyrare) and a tenant (hyresgäst). The term is used in Swedish rental practice and can cover residential, commercial, or other premises. Although some leases may be made verbally, a written uthyrningsakt is common and recommended to clarify the terms and reduce disputes.

A typical uthyrningsakt contains: identification of the par­ties and their addresses; a description of the leased premises; the purpose of use; start date and duration (fixed term or open-ended); rent amount, payment frequency, and any adjustments; security deposit and conditions for its return; responsibilities for utilities, maintenance, and repairs; rules regarding alterations, subletting, and pets; termination and notice periods; renewal terms and rent review procedures; and remedies for breach or non-payment. It may also include attachments such as inventories or condition reports.

Types and use: uthyrningsakter can be used for residential leases as well as commercial or industrial leases. They may be standard templates or tailored agreements, and can be amended by written addenda over time.

Legal framework: In Sweden, tenancy relationships are primarily governed by hyreslagen, which is part of Jordabalken. For disputes, hyresnämnden or civil courts may be involved. While not strictly required by law to have a written document, a well-drafted uthyrningsakt provides clear evidence of the agreed terms and helps protect both parties’ rights.
