Tõrkeohutus

Törkeohutus is a concept in Estonian law that relates to the assessment of the severity of a crime. It is used to determine the level of punishment that should be imposed on a convicted offender. The term translates to "seriousness of a crime" in English.

In Estonian legal terminology, törkeohutus refers to one of the three key factors that are taken into account when assessing the severity of a crime. The other two factors are the intention and the methods used by the offender. The level of törkeohutus is determined by the court based on the circumstances surrounding the crime.

Törkeohutus is divided into several levels, ranging from the lowest to the most severe. The lowest level is considered to be minor, while the highest level is defined as most serious. The court considers the following factors when determining the level of törkeohutus: the impact of the crime on society, the level of damage caused, and the severity of the victim's injuries.

The severity of a crime determines the type and length of punishment that can be imposed. In Estonia, the standard punishment is a fine or imprisonment, but in more severe cases, the punishment can include other penalties such as community service or loss of rights. Courts must take into account the törkeohutus when deciding on a fair and proportional punishment, taking into account the general principles of Estonian law and the European Convention on Human Rights.
