Skadeståndsfrågor, in Swedish law, refer to matters concerning compensation for damages. This encompasses legal principles and procedures designed to address situations where one party has suffered a loss or injury due to the actions or negligence of another. The fundamental aim of skadestånd is to restore the injured party to the position they were in before the damage occurred, as far as is practically possible, or to provide financial compensation for the harm suffered.

There are generally two main categories of damages considered: economic damages (sakskada and personskada) and non-economic damages (ideell skada). Economic damages typically include direct financial losses such as repair costs for damaged property, medical expenses, and lost income. Non-economic damages, often referred to as pain and suffering, compensate for physical pain, mental distress, and loss of enjoyment of life.

Establishing liability is a crucial aspect of skadeståndsfrågor. This usually involves proving that a wrongful act or omission occurred, that this act caused the damage, and that there is a causal link between the act and the damage. Legal frameworks, such as the Swedish Tort Liability Act (Skadeståndslagen), provide the basis for determining fault and the extent of compensation. The concept of negligence (vårdslöshet) is often central to establishing liability.

In some cases, strict liability may apply, meaning compensation can be awarded even if no fault can be proven on the part of the party causing the damage. This is often seen in areas like product liability or environmental damage. The process of seeking skadestånd can involve negotiation between the parties, mediation, or ultimately, legal proceedings in court.
