Seadusevälised can encompass customary or community-based dispute resolution, informal sanctions, or private enforcement mechanisms that function alongside or beyond official courts and police.

A key distinction is between extralegal and illegal. Extralegal does not automatically mean illegal; some extralegal practices are tolerated, recognized locally, or embedded in customary law, while others violate national or international standards. At the same time, extralegal authority can arise in contexts such as transitional justice, post-conflict settings, or areas with limited state reach, where formal justice is slow or inaccessible.

Critics of seaduseväliste mechanisms point to risks of reduced accountability, potential human rights abuses, and unequal treatment if informal norms override universal standards of due process and equality before the law. Proponents argue that such mechanisms can complement formal justice by offering culturally resonant dispute resolution, quicker remedies, and relief in environments where the state cannot fully provide services.
