Samþykki

Samþykki is an Icelandic noun meaning acceptance, approval, or consent. It denotes permission given by a person for something to occur, or for information, actions, or rights to be used or applied. The term is commonly used in legal, medical, and everyday contexts.

Etymology: The word combines sam- ("together" or "in common") and þykja ("to deem, to approve"). It appears in Icelandic laws and documents to indicate that a party has willingly agreed to terms.

Legal and contractual contexts: In Icelandic law, samþykki is required for agreements that affect a person’s rights or obligations, such as contracts, medical treatment, or the use of personal data. The concept distinguishes consent from coercion or mere assent; informed and voluntary consent is emphasized.

Medicine and research: Medical treatment typically requires patient consent, with guardians providing consent for minors or incapacitated individuals. In research, participants must be informed about aims, risks, and benefits and give voluntary samþykki. Both can be withdrawn at any time.

Data protection and digital privacy: Under Icelandic and EU law, processing of personal data often relies on samþykki as a lawful basis, which must be freely given, specific, informed, and unambiguous. Consent can be withdrawn, and providers must enable easy withdrawal and record the terms of consent.
