Rörelserätt

Rörelserätt is a Swedish term that literally means the right to move. The phrase is used in several legal contexts, and its precise meaning depends on the domain, such as civil liberties, immigration and border law, or property and land-use law. In each case, rörelserätt concerns the ability of persons to travel, reside, or pass through space under certain conditions.

In human rights and public-law contexts, rörelserätt usually refers to the freedom of movement. This includes the right to travel within a country and, for many jurisdictions, the right to move between countries. In the European Union, for example, the free movement of persons is a fundamental principle that allows EU citizens to live, work, study, and retire in member states, subject to applicable rules and restrictions.

In property law, rörelserätt can denote a right of way or access across another person’s land. Such rights may arise through servitude, contract, or statute and are enforceable against the owner of the land. They are typically established to enable access to roads, utilities, or other essential facilities.

Limitations and balancing: rörelserätt can be restricted for legitimate reasons such as public safety, health, or order.
