Rivningsbeslut

Rivningsbeslut is a formal administrative decision in Sweden to demolish a building or other structure. It is issued by a municipality or another competent authority under applicable planning and building legislation, typically within the framework of Plan- och bygglagen (PBL) and related regulations.

The decision is usually motivated by considerations of safety, health, or the feasibility of renovation or reuse. It can also be part of a redevelopment plan that necessitates removal of the existing structure. A rivningsbeslut may order demolition, or grant permission to demolish, often with specified conditions. These conditions can include handling of hazardous materials, requirements for site cleanup, safeguarding of adjacent properties, or constraints related to subsequent development on the plot.

Process and content: Before issuing a rivningsbeslut, the authority conducts an assessment of the building’s condition, alternatives to demolition, and the implications for area planning. The decision states what is to be demolished, the scope of works, any conditions, and the timeframe for carrying out the demolition. It may also reference requirements related to waste management and safety during demolition. In cases involving protected cultural heritage, additional permissions under other laws may apply.

Appeals and enforcement: The decision can typically be appealed by the owner or other affected parties to the county administrative board within a defined appeal period.
