Oppholdstillatelse

Oppholdstillatelse is a legal permission to reside in Norway for a defined period, issued by Norwegian authorities. It is distinct from a visa or tourist stay and is governed by the Utlendingsloven (Immigration Act). The permit is issued by the Utlendingsdirektoratet (UDI) and, if challenged, can be reviewed by the Utlendingsnemnda (UNE). A person holding oppholdstillatelse has the right to live in Norway for the duration of the permit and, depending on the type, may have the right to work or study as part of the authorization.

There are several main types of oppholdstillatelse. Midlertidig oppholdstillatelse (temporary) is given for specific purposes such as work, studies, family reunification, or protection as a refugee or for other humanitarian grounds. Varig oppholdstillatelse (permanent) can be granted after meeting certain conditions and a period of residence with valid permits. In addition to these, asylum or protection status can lead to a form of residence permit. The rules differ for EU/EEA citizens and for third-country nationals, and several categories may require job offers, family ties, or recognized refugee status.

Applications are typically submitted to UDI, often online, with supporting documentation. Applicants may need to provide biometrics, pay a fee, and await a decision whose duration varies by category. Some decisions can be appealed to UNE. The permit may be renewed or extended before expiry, and permanent residence may be attainable after meeting specified criteria. Holders of oppholdstillatelse gain rights to reside, and in many cases to work and access services such as healthcare and education, while remaining subject to ongoing eligibility, reporting requirements, and potential obligations to maintain residence conditions.
