Nödvillkoren, a Swedish legal term, translates to "conditions of necessity" or "necessity as a defense." It refers to a legal principle that allows an individual to commit a crime or cause harm to avoid a greater, imminent danger. This defense is typically invoked when an act that would otherwise be unlawful is committed to protect oneself or others from a serious and unavoidable threat.

The application of nödvillkoren requires strict conditions to be met. Firstly, there must be an actual and immediate danger. This danger cannot be a hypothetical or future risk. Secondly, the act committed in defense must be proportionate to the threat. The harm caused must not be excessive compared to the harm being avoided. For example, causing serious injury to protect a minor inconvenience would not be considered nödvillkor. Thirdly, there must be no other reasonable way to avert the danger. The individual must have exhausted all other legal and safe options before resorting to the unlawful act.

Nödvillkoren is a part of Swedish criminal law and is designed to provide a legal escape route in extreme circumstances where adhering strictly to the law would lead to a demonstrably worse outcome. It is not a blanket excuse for criminal behavior but a narrowly interpreted defense that considers the exceptional nature of the situation.
