Löschungsrechte

Löschungsrechte, often translated as "right to erasure" or "right to be forgotten," are legal provisions that grant individuals the right to request the deletion of their personal data under certain circumstances. These rights are a key component of data protection regulations, most notably the General Data Protection Regulation (GDPR) in the European Union.

The right to erasure is not absolute and is subject to specific conditions. It typically applies when personal data is no longer necessary for the purpose for which it was collected, when consent for processing is withdrawn and there is no other legal ground for processing, or when the data has been unlawfully processed. Individuals can also invoke this right if they object to the processing of their data and there are no overriding legitimate grounds for the continued processing.

Organizations that process personal data have an obligation to respond to erasure requests. They must assess whether the conditions for erasure are met and, if so, delete the data without undue delay. However, there are exceptions to the right to erasure. For instance, it may not apply if the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for archiving purposes in the public interest, scientific or historical research purposes, or for the establishment, exercise, or defense of legal claims.
