Haustürverträge

Haustürverträge, also known as doorstep contracts or off-premises contracts in English-speaking countries, are agreements concluded outside of a business's regular premises. This typically occurs in the consumer's home, but also at their workplace, on the street, or during excursions organized by the seller. The defining characteristic is that the consumer is solicited and makes a declaration of intent away from the seller's established business location.

The legal framework surrounding Haustürverträge is designed to protect consumers from potentially pressured or impulsive purchasing decisions. In many jurisdictions, these contracts are subject to special regulations that grant consumers a right of withdrawal, often referred to as a cooling-off period. This period allows the consumer to reconsider their decision and cancel the contract without providing a reason, usually within a specified timeframe, such as two weeks.

To ensure consumer protection, sellers engaging in Haustürgeschäfte are typically required to provide the consumer with specific information in writing before or at the time the contract is concluded. This information usually includes details about the goods or services, the total price, the seller's identity and contact information, and crucially, clear instructions on how to exercise the right of withdrawal and the duration of this right. Failure to provide this information can sometimes extend the withdrawal period. The rationale behind these regulations is to level the playing field, as consumers may feel less comfortable refusing a salesperson in their own environment.
