Felhatalmazottak

Felhatalmazottak are individuals who have been granted authority by another person or organization to perform specific acts or make certain decisions on their behalf, within the limits set by the authorization. They act as representatives or agents in civil, commercial, administrative, or organizational contexts. The act of granting authority is known as felhatalmazás, and the person who receives it is the felhatalmazott.

The scope of the authorization can be general, allowing a broad range of acts, or specific, covering only particular tasks or transactions. The form of the felhatalmazás varies by context and law; it can be written or, in some situations, oral, though many important acts require written form for validity. In some jurisdictions, certain transactions—such as real estate dealings or significant financial operations—may demand additional formalities, such as notarial or certified documentation.

Legal effects and duties: acts performed by the felhatalmazott within the authorized scope bind the principal. The felhatalmazott has fiduciary duties, including loyalty, good faith, and avoidance of conflicts of interest; they may be required to keep records, report progress, and act in the principal’s best interests. Exceeding the authorized scope or acting without proper authority can expose the felhatalmazott to liability and may terminate or invalidate the authorization.

Termination and duration: felhatalmazás can be revoked by the principal at any time, may expire upon a set date or condition, or terminate upon the principal’s death or incapacity. In organizational settings, internal rules may govern the appointment, powers, and removal of felhatalmazottak.
