Europapatent

Europapatent, in the context of European intellectual property law, is a patent granted by the European Patent Organisation under the European Patent Convention (EPC). It enables the applicant to obtain protection in several European states through a single patent application and grant process.

Procedure for a Europapatent begins with filing an application with the European Patent Office (EPO). The application undergoes formal examination, a search for prior art, and substantive examination for novelty, inventive step, and industrial applicability. If the application meets the requirements, the EPO grants a patent. The grant yields a single patent right that can be validated in designated member states.

Designation and validation involve the applicant selecting multiple EPC contracting states in which protection is sought. After grant, the patent must be validated in each designated country, typically requiring translations into the official language of the country or meeting local legal requirements, and payment of national fees. Validation times and translation requirements vary by state.

Renewal and maintenance mean the patent remains in force for up to 20 years from the filing date, subject to annual renewal fees in each designated state.

Opposition and appeal: After grant, there is a nine-month window during which third parties may oppose the patent at the EPO. Decisions can be appealed to the EPO Boards of Appeal.

Unitary patent note: In addition to the traditional European patent route, a unitary patent system has been developed to provide unitary protection across many member states, administered by the EPO and enforced by the Unified Patent Court when fully in force.
