In many legal frameworks, particularly within the European Union's General Data Protection Regulation (GDPR), the processing of personal data is not absolutely prohibited but is subject to certain conditions and exceptions. These exceptions often require a balancing act between the fundamental right to data protection and other legitimate interests.

This balancing process typically involves assessing the necessity and proportionality of the data processing in relation to the purpose it serves. For example, a company might need to process certain employee data for legitimate business operations. However, this processing must be limited to what is strictly necessary for that purpose, and the rights and freedoms of the employees must be taken into account. If the processing disproportionately infringes on an individual's privacy, it may not be deemed lawful even if it serves a seemingly legitimate goal.

Regulators and courts often have to decide whether the benefits of processing personal data in these contexts outweigh the potential harm to individuals' privacy.
