CMRconventies

CMRconventies refers to a set of international agreements governing the international carriage of goods by road. The most prominent of these is the Convention on the Contract for the International Carriage of Goods by Road, commonly known as the CMR Convention, which entered into force in 1961. This convention harmonizes the legal conditions of international road transport, particularly concerning the documents used, the rights and responsibilities of the parties involved, and liability for loss or damage to goods.

The CMR consignment note is a key document prescribed by the convention. It serves as evidence of the contract of carriage, a receipt for the goods, and contains essential details such as the names and addresses of the sender, carrier, and consignee, the nature and quantity of the goods, and the place and date of departure and arrival. While the CMR consignment note is not a negotiable document, it plays a crucial role in defining the terms of the agreement.

The convention also lays down rules regarding the carrier's liability. In general, the carrier is liable for loss, damage, or delay to the goods, unless they can prove that the loss or damage was caused by specific circumstances beyond their control, such as the inherent vice of the goods or faulty packing. The CMR sets limits on the amount of compensation a carrier can be liable for, which are typically linked to the weight of the goods.

These conventions are ratified by numerous European countries and have significantly facilitated international road freight transport by providing a clear and consistent legal framework. They ensure greater certainty for shippers, carriers, and consignees engaged in cross-border logistics.
