Avtalsbildning
Avtalsbildning refers to the process by which an agreement is formed between two or more parties. In Swedish law, this process is fundamental to the creation of legally binding contracts. The core elements of avtalsbildning typically involve an offer and an acceptance. An offer is a declaration of intent to enter into a contract on specific terms, which must be clear and definite enough to allow for a simple yes or no answer. Acceptance is the unqualified agreement to the terms of the offer. If the acceptance deviates from the offer, it is generally considered a counter-offer, thereby rejecting the original offer.
The formation of an agreement can occur in various ways, including orally, in writing, or through conduct.
