Aufteilungsquoten
Aufteilungsquoten, often translated as "division quotas" or "allocation quotas," are a concept primarily found in German property law, particularly within the context of condominium ownership (Wohnungseigentum). These quotas are crucial for determining the individual share of ownership of common property and the associated rights and obligations of each co-owner. Essentially, an Aufteilungsquote assigns a percentage value to each individual unit within a building that has been divided into separate ownership. This percentage is not arbitrary but is typically calculated based on the unit's size, often its living area, in relation to the total size of all units in the building. The Aufteilungsquote dictates a co-owner's proportionate stake in the shared areas, such as the staircase, hallways, roof, and land. Furthermore, it forms the basis for calculating each owner's financial contributions to the maintenance and repair of the common property, often referred to as Hausgeld or Nebenkosten. A higher Aufteilungsquote generally means a larger share of the common property and a correspondingly larger responsibility for its upkeep. These quotas are legally established during the process of dividing a property into condominiums and are recorded in the land register. While the size of the living area is the most common basis, other factors can sometimes be considered, though this is less frequent and must be clearly defined. Understanding one's Aufteilungsquote is therefore fundamental for any co-owner in a German condominium.
