Arrendament

Arrendament is a contractual arrangement by which the owner of an asset, typically land, a building, or movable property, grants another party the right to use the asset for a defined period in exchange for rent. The parties are the arrendator (landlord) and the arrendatar (tenant). The contract sets the duration, the rent amount and payment schedule, permissible uses of the asset, and any conditions for maintenance and return of the asset at the end of the term.

In real estate and agricultural contexts, arrendament is commonly used to lease rural land to farmers or to lease urban property for business or residential use. The tenant is usually responsible for routine maintenance and compliance with applicable laws, while the landlord may be responsible for major structural repairs, depending on the contract. The agreement may include provisions on subletting, assignment, renewal, rent indexing, security deposits, and remedies for breach or termination.

Termination can occur at the end of the term, by mutual agreement, or earlier for cause, subject to notice requirements and contractual penalties. Upon termination, the asset is returned in the agreed condition, allowing for wear and tear and any contractually specified restoration. Arrendament is governed by applicable property and civil law within a jurisdiction and may interact with related concepts such as leases, tenancies, and usufruct.
