Arbitralitási

Arbitralitási refers to the process of resolving disputes through arbitration, a form of alternative dispute resolution (ADR). Instead of going to court, parties agree to submit their disagreement to one or more neutral third parties, known as arbitrators, who will make a binding decision. This decision is called an award. Arbitration is often chosen for its perceived efficiency, confidentiality, and the ability to select arbitrators with specific expertise in the subject matter of the dispute. It can be a contractual agreement, meaning parties agree to arbitrate future disputes, or a submission agreement, where parties agree to arbitrate an existing dispute. The rules governing arbitration can be established by arbitration institutions, such as the International Chamber of Commerce (ICC) or the American Arbitration Association (AAA), or by the parties themselves. The arbitral award is generally enforceable by courts, making it a powerful mechanism for dispute resolution. While arbitration offers advantages, it can also be costly and may lack the full procedural safeguards found in court proceedings.
