The concept is governed by German labor law, particularly under the *Arbeitsstättenverordnung* (Workplace Ordinance), which aims to ensure health, safety, and ergonomic standards for employees.

The definition encompasses a broad range of settings, including offices, workshops, factories, retail stores, and even temporary or mobile workplaces such as construction sites or field offices. Unlike the term *Betriebsstätte* (establishment), which pertains to a fixed location where a business operates, an *Arbeitsstätte* focuses specifically on where work is carried out, regardless of the employer’s broader operational structure.

Key legal requirements under the *Arbeitsstättenverordnung* include adequate ventilation, proper lighting, ergonomic workstations, and measures to prevent accidents or health hazards. Employers must conduct regular inspections and provide necessary protective equipment, such as safety shoes or screens to reduce glare. Special provisions apply to hazardous environments, such as those involving chemicals, noise, or radiation.

For remote workers, the concept also applies if the employer provides equipment or exercises control over the work process, as the workplace may still fall under occupational health and safety regulations. Self-employed individuals are generally not subject to the same strict oversight but are encouraged to follow voluntary safety guidelines.
